Welcome to Aruba Discovery.

These Terms and Conditions govern your access to and use of https://arubadiscovery.com, including its pages, listings, contact forms, inquiry features, booking tools, payment features, maps, guides, event information, and other services made available through the website.

Please read these Terms and Conditions carefully before using ArubaDiscovery.com.

By accessing or using the website, submitting an inquiry, making a booking, or completing a payment through the platform, you confirm that you have read, understood, and agreed to these Terms and Conditions.

If you do not agree with these Terms and Conditions, you should not use the website.

1. About Aruba Discovery

Aruba Discovery is an informational tourism portal that helps visitors discover businesses, places, restaurants, venues, artists, events, tours, activities, experiences, and other services related to Aruba.

The website is operated by:

Website operator: Aruba Discovery
Website: https://arubadiscovery.com
Address: Caya Betico Croes 76, Local 5, Oranjestad, Aruba, Aruba
Contact: contact@arubadiscovery.com

In these Terms and Conditions, “Aruba Discovery,” “we,” “us,” and “our” refer to the operator of ArubaDiscovery.com.

“User,” “you,” and “your” refer to any person who accesses or uses the website.

“Partner” refers to any business, restaurant, venue, artist, event organizer, tour operator, activity provider, experience provider, transportation provider, or other third-party service provider listed or promoted on the website.

2. Nature of the Platform

Aruba Discovery primarily provides tourism information and facilitates communication between visitors and independent Partners.

Unless expressly stated otherwise, Aruba Discovery does not own, operate, manage, control, or directly provide the businesses, accommodations, tours, events, activities, experiences, products, or services displayed on the website.

Partners are independent third parties and are responsible for:

  • The services they advertise or provide;
  • The accuracy of their listing information;
  • Availability, schedules, and opening hours;
  • Prices, taxes, and additional charges;
  • Booking acceptance and confirmation;
  • Customer service;
  • Safety and regulatory compliance;
  • Licenses, permits, and insurance;
  • Cancellations and refunds;
  • The quality and delivery of their services;
  • Their own terms, policies, and privacy practices.

Aruba Discovery acts as an informational and technology platform and, where booking functionality is available, may act as an intermediary between the User and the relevant Partner.

3. Acceptance of These Terms

You accept these Terms and Conditions when you:

  • Access or browse the website;
  • Use a search, map, filter, or directory feature;
  • Submit a contact form or inquiry;
  • Contact a Partner through the website;
  • Create an account, where account functionality is available;
  • Make or request a booking;
  • Submit payment through the platform;
  • Otherwise use any service made available through ArubaDiscovery.com.

Additional terms may apply to particular bookings, payments, promotions, Partners, or services. These additional terms will be displayed or made available before the relevant transaction whenever reasonably possible.

If additional terms conflict with these general Terms and Conditions, the more specific terms will apply to the relevant service or transaction.

4. Eligibility

You must be legally capable of entering into a binding agreement to use transactional features of the website.

Users under the age of 18 may browse the website but should only submit inquiries, make bookings, or complete payments with the involvement and permission of a parent or legal guardian.

By making a booking or payment, you confirm that:

  • You are at least 18 years old; or
  • You have permission and supervision from a parent or legal guardian;
  • The information you provide is accurate;
  • You have authority to make the booking for yourself and any other guests included in it;
  • You are authorized to use the selected payment method.

5. Information Provided on the Website

We aim to provide helpful and reasonably accurate information. However, information may be supplied directly by Partners, public sources, event organizers, contributors, or other third parties.

Information displayed on ArubaDiscovery.com may include:

  • Business descriptions;
  • Addresses and map locations;
  • Contact details;
  • Opening hours;
  • Photographs and videos;
  • Prices and price ranges;
  • Menus;
  • Tour descriptions;
  • Event schedules;
  • Artist information;
  • Availability;
  • Amenities and facilities;
  • Policies and restrictions;
  • Accessibility information;
  • Transportation or direction information.

Such information may change without notice.

Aruba Discovery does not guarantee that all information is complete, current, error-free, or suitable for a particular User.

Users should verify important details directly with the relevant Partner before travelling, attending an event, making a purchase, or relying on information that could materially affect their plans.

6. Maps, Locations, and Directions

Maps, distances, estimated travel times, directions, and geographic information are provided for general guidance only.

Map information may be supplied by external mapping providers and may not always reflect current road conditions, entrances, closures, construction, accessibility, parking, or exact property boundaries.

Users are responsible for verifying their route and destination before travelling.

Aruba Discovery is not responsible for loss, delay, missed bookings, or inconvenience caused by inaccurate map information, directions, or estimated travel times.

7. Inquiries and Contact Requests

Users may be able to send inquiries to Partners through forms or communication tools on ArubaDiscovery.com.

An inquiry may include information such as:

  • Name;
  • Email address;
  • Telephone or WhatsApp number;
  • Requested date and time;
  • Number of guests;
  • Preferred service;
  • Questions or special requests;
  • Other information voluntarily provided by the User.

Submitting an inquiry does not automatically create a confirmed booking or legally binding agreement.

A booking is only confirmed when the relevant Partner or Aruba Discovery provides a clear confirmation.

Aruba Discovery may forward the User’s inquiry to the selected Partner or an authorized representative of that Partner.

If no appropriate Partner contact is available, Aruba Discovery may receive, review, or redirect the inquiry so it can be handled correctly.

The Partner remains responsible for responding to the inquiry, confirming availability, and providing the requested service.

8. Booking Requests

Where booking functionality is available, Users may request or make reservations for tours, activities, experiences, restaurants, events, transportation, or other Partner services.

A submitted booking request may be subject to:

  • Partner availability;
  • Minimum or maximum guest numbers;
  • Age restrictions;
  • Health or participation requirements;
  • Weather or safety conditions;
  • Minimum spending requirements;
  • Deposit or prepayment requirements;
  • Partner confirmation;
  • Additional Partner terms.

A booking request is not guaranteed to be accepted.

The booking becomes confirmed only when the User receives a confirmation through the website, email, message, or another communication method identified during the booking process.

Users are responsible for checking that all confirmation details are correct and contacting us or the Partner promptly if anything is inaccurate.

9. Contract With the Partner

Unless clearly stated otherwise during the booking process, the contract for the actual tour, activity, event, experience, product, or service is formed directly between the User and the relevant Partner.

Aruba Discovery is not a party to that service contract merely because:

  • The Partner is listed on the website;
  • The inquiry was submitted through ArubaDiscovery.com;
  • The booking was facilitated by the platform;
  • Payment was processed through a payment provider connected to the platform.

The Partner is responsible for fulfilling the booked service according to the confirmed details and applicable Partner terms.

Aruba Discovery may assist with communications, support, or dispute resolution but does not guarantee the outcome of a dispute between a User and a Partner.

10. Prices and Currency

Prices displayed on the website may be provided by Partners and may change without notice.

The currency applicable to a booking will be displayed before payment or confirmation.

Depending on the Partner and service, prices may or may not include:

  • Local taxes;
  • Service charges;
  • Booking fees;
  • Gratuities;
  • Transportation;
  • Equipment rental;
  • Food and beverages;
  • Entry fees;
  • Security deposits;
  • Optional extras;
  • Foreign exchange or bank fees.

Users are responsible for reviewing the full price breakdown before confirming a booking.

If there is an obvious pricing or technical error, Aruba Discovery or the Partner may cancel or correct the affected transaction. In such a case, any amount incorrectly charged will be refunded according to the applicable payment and refund process.

11. Online Payments

When online payment functionality is enabled, payments may be processed by an independent third-party payment processor.

Aruba Discovery may not directly receive or store complete payment card information.

By submitting payment, you confirm that:

  • You are authorized to use the payment method;
  • The billing information provided is accurate;
  • Sufficient funds or credit are available;
  • You agree to any displayed price, taxes, fees, and currency conversion;
  • You authorize the payment processor to process the transaction.

Payment processing may be subject to additional terms and privacy policies of the relevant payment provider.

Aruba Discovery is not responsible for:

  • Payment provider outages;
  • Bank declines;
  • Card restrictions;
  • Currency conversion rates;
  • International transaction fees;
  • Incorrect billing information submitted by the User;
  • Delays caused by banks or payment networks.

A payment receipt does not necessarily mean that the Partner has accepted the booking unless the booking is also expressly confirmed.

12. Deposits, Prepayments, and Booking Fees

Certain Partners may require:

  • Full advance payment;
  • A partial deposit;
  • A card authorization;
  • Payment upon arrival;
  • A booking or service fee.

The applicable payment arrangement will be displayed during the booking process or communicated by the Partner.

Any fee charged directly by Aruba Discovery will be clearly identified before the User completes payment.

Booking, platform, processing, or service fees may be non-refundable where clearly disclosed before purchase, except where a refund is required by applicable law or the service was not provided because of an error attributable to Aruba Discovery.

13. Cancellations by Users

Cancellation rules may vary by Partner, booking, date, service, and rate type.

Before confirming a booking, Users should review the cancellation policy displayed during the booking process or provided by the Partner.

Depending on the applicable policy:

  • A booking may be fully refundable before a stated deadline;
  • A partial cancellation charge may apply;
  • A deposit may be non-refundable;
  • The full booking amount may be charged for late cancellation;
  • No refund may be available for a no-show;
  • Rescheduling may be offered instead of a refund.

A cancellation is effective only when it is submitted through an approved cancellation method and the User receives confirmation that the cancellation has been processed.

Contacting the Partner informally does not guarantee that the booking has been cancelled.

14. Cancellations by Partners

Partners may cancel or modify a booking due to circumstances such as:

  • Severe weather;
  • Unsafe operating conditions;
  • Equipment failure;
  • Staff unavailability;
  • Insufficient participation;
  • Event cancellation;
  • Venue closure;
  • Government restrictions;
  • Emergencies;
  • Other circumstances that make performance impossible or unsafe.

If a Partner cancels a confirmed prepaid booking, the Partner will generally be responsible for providing the applicable refund, credit, rescheduling option, or alternative service, subject to its policies and applicable law.

Aruba Discovery may help communicate with the Partner but is not responsible for additional costs such as accommodation, transportation, flights, meals, or lost time unless Aruba Discovery expressly agreed in writing to cover them.

15. Refunds

Refund eligibility depends on:

  • The Partner’s cancellation policy;
  • The rate or booking conditions selected;
  • The timing of the cancellation;
  • Whether the service was delivered;
  • The reason for cancellation;
  • Mandatory rights under applicable law.

Approved refunds will generally be returned to the original payment method.

The time required for a refund to appear may depend on the Partner, payment processor, bank, card issuer, or payment method.

Aruba Discovery cannot guarantee the exact time in which a bank or card provider will display a processed refund.

Where Aruba Discovery collected payment only as an intermediary, the refund may depend on the Partner authorizing or providing the relevant funds.

16. No-Shows and Late Arrival

Users are responsible for arriving at the correct location at the required time.

A Partner may treat the booking as a no-show if the User:

  • Does not arrive;
  • Arrives after the permitted check-in or departure time;
  • Goes to an incorrect location;
  • Fails to provide required documents;
  • Does not meet stated participation requirements;
  • Cannot be contacted using the information provided.

A no-show may result in the loss of the deposit or full booking amount, depending on the Partner’s policy.

Users should contact the Partner as soon as possible if they expect to be late.

17. User Responsibilities

When using ArubaDiscovery.com, you agree to:

  • Provide accurate and complete information;
  • Keep your contact details current;
  • Review booking details before confirmation;
  • Follow reasonable Partner instructions;
  • Behave respectfully toward Partners, staff, other guests, and the public;
  • Comply with applicable laws and local regulations;
  • Observe safety, age, dress, health, and conduct requirements;
  • Use the website only for lawful purposes;
  • Pay all agreed charges;
  • Avoid making false, fraudulent, or speculative bookings.

You are responsible for ensuring that all persons included in your booking understand and comply with the relevant conditions.

18. Health, Safety, and Participation Requirements

Certain tours, activities, and experiences may involve physical activity, water, transportation, wildlife, weather exposure, or other inherent risks.

Partners may impose participation requirements relating to:

  • Age;
  • Height or weight;
  • Swimming ability;
  • Physical fitness;
  • Pregnancy;
  • Medical conditions;
  • Medication;
  • Alcohol consumption;
  • Clothing or footwear;
  • Safety equipment;
  • Signed waivers.

Users are responsible for reviewing these requirements and determining whether a service is appropriate for themselves and their group.

Relevant medical conditions or accessibility needs should be communicated directly to the Partner before booking or participation.

Aruba Discovery does not provide medical, safety, or professional advice and does not independently assess whether a particular activity is suitable for a specific User.

19. Weather and Local Conditions

Tours, events, marine activities, outdoor experiences, and transportation may be affected by weather, sea conditions, traffic, public events, government measures, or other local circumstances.

Schedules, routes, locations, and included activities may be changed for safety or operational reasons.

A change caused by weather or safety concerns does not automatically entitle the User to a refund. The applicable Partner policy will determine whether the User receives a refund, credit, rescheduling option, or alternative service.

20. Prohibited Use

You may not use ArubaDiscovery.com to:

  • Break any applicable law;
  • Submit false or misleading information;
  • Impersonate another person or business;
  • Make fraudulent or unauthorized transactions;
  • Submit spam or unsolicited promotional content;
  • Harass, threaten, or abuse another person;
  • Interfere with the website’s security or operation;
  • Introduce malware, harmful code, or automated attacks;
  • Scrape, copy, or extract website data without authorization;
  • Attempt to gain unauthorized access to accounts or systems;
  • Avoid or manipulate fees, booking processes, or technical restrictions;
  • Use content from the website to build a competing database or directory without permission;
  • Infringe intellectual property, privacy, or other legal rights.

We may restrict or terminate access to the website where we reasonably believe these Terms have been violated.

21. Accounts

If user or Partner accounts are introduced, account holders will be responsible for:

  • Maintaining the confidentiality of login details;
  • Providing accurate account information;
  • Preventing unauthorized account access;
  • Informing Aruba Discovery promptly of suspected misuse;
  • All activity performed through their account.

We may suspend, restrict, or close an account where:

  • False information has been provided;
  • Fraud or misuse is suspected;
  • Payments are disputed improperly;
  • The User repeatedly fails to honor bookings;
  • The account violates these Terms;
  • Suspension is necessary for security or legal reasons.

22. Partner Listings

Partners that submit or manage listings agree that:

  • Their business information is accurate and current;
  • They are authorized to offer the advertised services;
  • They hold any required registrations, permits, licenses, and insurance;
  • Their photographs and content do not infringe third-party rights;
  • Displayed prices and conditions are not misleading;
  • They will honor confirmed bookings, subject to applicable cancellation terms;
  • They will handle Users fairly and professionally;
  • They will comply with applicable consumer, safety, tax, and privacy obligations.

Aruba Discovery may edit, reject, suspend, or remove a listing that is inaccurate, outdated, misleading, unlawful, incomplete, or harmful to Users or the platform.

Publication of a listing does not constitute certification, endorsement, or verification of every statement made by the Partner.

23. Reviews and User Content

If reviews, comments, photographs, or other user-submitted content are enabled, Users remain responsible for the content they submit.

Submitted content must:

  • Reflect a genuine experience;
  • Be relevant and accurate;
  • Avoid defamatory or knowingly false statements;
  • Avoid threats, harassment, discrimination, or abusive language;
  • Avoid publishing private personal information;
  • Respect copyright and other intellectual property rights;
  • Not contain advertising, spam, or manipulated reviews.

By submitting content, you grant Aruba Discovery a non-exclusive, worldwide, royalty-free license to host, reproduce, display, format, and use that content in connection with the platform and its promotion.

We may moderate, reject, or remove content that violates these Terms, although we are not obligated to monitor every submission.

24. Intellectual Property

The website and its original content, design, branding, structure, software, text, graphics, logos, and functionality are owned by or licensed to Aruba Discovery and are protected by applicable intellectual property laws.

Partner names, trademarks, images, and content may belong to their respective owners.

You may use the website for personal, non-commercial travel research and booking purposes.

You may not, without prior written permission:

  • Reproduce substantial parts of the website;
  • Republish listings or databases;
  • Copy website design or software;
  • Use Aruba Discovery branding;
  • Sell or commercially exploit website content;
  • Remove copyright or ownership notices;
  • Create derivative commercial services from website data.

Sharing individual public pages through ordinary links or social-media sharing tools is permitted.

25. Third-Party Websites and Services

ArubaDiscovery.com may contain links to:

  • Partner websites;
  • Social-media platforms;
  • Payment providers;
  • Ticketing systems;
  • External booking services;
  • Map providers;
  • Video platforms;
  • Other third-party services.

Aruba Discovery does not control these external services and is not responsible for their:

  • Availability;
  • Accuracy;
  • Content;
  • Security;
  • Privacy practices;
  • Transactions;
  • Products or services.

Use of an external website is subject to that provider’s own terms and policies.

26. Promotions and Sponsored Content

Some listings, placements, articles, recommendations, or advertisements may be sponsored, promoted, or commercially supported.

Sponsored status may influence visibility or placement but does not change the Partner’s responsibility for its services.

Aruba Discovery does not guarantee the quality or suitability of a Partner merely because the Partner has purchased advertising or promotional placement.

Special offers may be subject to additional conditions, dates, availability, or restrictions.

27. Availability of the Website

We aim to keep ArubaDiscovery.com accessible and functional but do not guarantee uninterrupted availability.

The website may be unavailable because of:

  • Maintenance;
  • Software updates;
  • Hosting problems;
  • Security incidents;
  • Network failures;
  • Third-party service failures;
  • Events outside our reasonable control.

We may modify, suspend, replace, or discontinue any part of the website without prior notice.

We are not responsible for losses caused solely by temporary website unavailability, except where liability cannot legally be excluded.

28. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the website is provided on an “as is” and “as available” basis.

Aruba Discovery does not guarantee that:

  • All content will be accurate or current;
  • Every Partner will be available;
  • Every inquiry will receive a response;
  • Every booking request will be accepted;
  • A Partner’s service will meet a User’s expectations;
  • The website will be uninterrupted or error-free;
  • The website will be free from all security threats;
  • External links or services will remain available.

Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

29. Limitation of Liability

To the fullest extent permitted by applicable law, Aruba Discovery will not be liable for indirect, incidental, special, consequential, or purely economic losses arising from the use of the website or services provided by independent Partners.

Aruba Discovery is not responsible for:

  • Acts, omissions, negligence, or misconduct of Partners;
  • Injury, illness, property damage, loss, or delay caused by a Partner;
  • Inaccurate information supplied by a Partner;
  • Cancelled or modified Partner services;
  • Lost belongings;
  • Missed transport or connections;
  • Weather or natural conditions;
  • External website or payment-provider failures;
  • User failure to follow booking or safety instructions;
  • Unauthorized use of a User’s account caused by the User’s failure to protect login information.

Where Aruba Discovery is found directly liable in connection with a paid transaction, its total liability will, to the fullest extent permitted by law, be limited to the amount paid directly to Aruba Discovery for the specific transaction giving rise to the claim.

This limitation does not apply where liability cannot legally be limited or excluded, including where applicable in cases of fraud, intentional misconduct, or gross negligence.

30. Indemnification

To the extent permitted by law, you agree to compensate Aruba Discovery for reasonable losses, claims, liabilities, and expenses arising from:

  • Your unlawful use of the website;
  • Fraudulent information or transactions;
  • Your violation of these Terms;
  • Your infringement of another person’s rights;
  • Content you submit to the website;
  • Actions taken through your account.

This provision does not require a consumer to compensate Aruba Discovery for losses caused by Aruba Discovery’s own unlawful conduct.

31. Force Majeure

Neither Aruba Discovery nor a Partner will be responsible for failure or delay caused by circumstances beyond reasonable control.

Such circumstances may include:

  • Severe weather;
  • Hurricanes;
  • Flooding;
  • Natural disasters;
  • Epidemics or public-health emergencies;
  • Government restrictions;
  • Strikes;
  • Civil disturbance;
  • Transport disruption;
  • Utility or internet failure;
  • Cybersecurity incidents;
  • Closure of ports, airports, roads, or venues.

Refunds or rescheduling in such cases will be handled according to the applicable booking conditions, Partner policy, and mandatory law.

32. Privacy

Personal information is handled according to the Aruba Discovery Privacy Policy.

By submitting an inquiry or booking request, you understand that relevant information may be shared with the selected Partner so that the Partner can respond, confirm availability, deliver the service, or manage the booking.

Users should review the Privacy Policy before submitting personal information.

33. Complaints and Disputes With Partners

Users should first raise service-related complaints directly with the relevant Partner as soon as possible.

Where practical, the Partner should be given a reasonable opportunity to address the problem while the service is still taking place.

Users may also contact Aruba Discovery at contact@arubadiscovery.com. We may assist with communication or request information from the Partner, but we do not guarantee a particular resolution.

A complaint should include:

  • The User’s name;
  • Booking or inquiry details;
  • The Partner’s name;
  • A description of the issue;
  • Supporting photographs, messages, receipts, or other relevant evidence;
  • The resolution requested.

34. Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws applicable in Aruba.

Any dispute concerning Aruba Discovery or the operation of ArubaDiscovery.com will be submitted to the competent courts of Aruba, unless mandatory consumer-protection law gives the User the right to bring a claim in another jurisdiction.

Before starting formal legal proceedings, the parties are encouraged to attempt to resolve the dispute through direct written communication.

35. Changes to These Terms

We may update these Terms and Conditions to reflect:

  • Changes to website functionality;
  • Introduction of bookings or payments;
  • New services;
  • Changes to Partner relationships;
  • Legal or regulatory requirements;
  • Security or operational changes.

The updated version will be published on this page with a revised “Last updated” date.

Changes will apply from the date they are published unless otherwise stated.

Terms applicable at the time of a confirmed booking will generally continue to apply to that booking unless a change is required by law or accepted by the User.

36. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will continue in effect.

The invalid provision will be interpreted or modified only to the minimum extent necessary to make it enforceable, where legally permitted.

37. No Waiver

If Aruba Discovery does not immediately enforce a provision of these Terms, that does not mean that the provision has been waived.

Any waiver must be clearly confirmed in writing.

38. Entire Agreement

These Terms and Conditions, together with the Privacy Policy, Cookie Policy, booking conditions, and any specific terms displayed during a transaction, form the agreement between the User and Aruba Discovery regarding use of the platform.

They do not replace the separate agreement between the User and the Partner that provides the booked service.
